Terms of service

Before clicking to agree to this Agreement during the application and registration process, please read it carefully. Please make sure to prudently review and fully understand all provisions, particularly those regarding exemption or limitation of liability, governing law, and dispute resolution. By creating a china travel joy Platform account, you acknowledge and agree to be bound by the following terms, conditions, and notices (collectively referred to as “this Agreement”). If you disagree with any provisions of this Agreement while you are reading, please terminate the registration procedure immediately. The China Travel Joy Platform is operated Beijing Du Mei Culture and Tourism Co., Ltd., while specific products or services (hereinafter referred to as “Products or Services”) are provided by either Beijing Du Mei  Culture and Tourism Co., Ltd. or qualified third-party suppliers. By accessing the China Travel Joy Platform, making reservations, or utilizing any Products or Services through the platform, you (hereinafter referred to as “User” or “You”) are deemed to have accepted the “China Travel Joy Platform User Service Agreement” (hereinafter referred to as “this Agreement”). Please read the following content carefully, especially the bold font sections. If you disagree with any of the following content, please stop accessing the China Travel Joy Platform or using any Products or Services provided through it immediately. You can perform this action or terminate this Agreement by closing your account and ceasing all access to or use of the services.

1. General provisions

This Agreement includes the main text of the Agreement, individual service agreements for sub-channels of the china travel joy Platform, and other rules already published or to be published by the china travel joy Platform in the future, including but not limited to disclaimers, personal information protection policies, personal information authorization statements, booking terms or notices, travel contracts, account cancellation agreements, and other agreements (hereinafter referred to as “Other Terms”). In the event of any inconsistency between this Agreement and the “Other Terms”, the “Other Terms” shall prevail. Unless otherwise explicitly stated, all products/services provided by the china travel joy Platform are subject to this Agreement.  

For the purposes of this Agreement:

– “China travel joy” refers to Beijing Du Mei  Culture and Tourism Co., Ltd., the developer and operator of china travel joy Platform.

– “China travel joy Platform” refers to the website with the primary domain name “chinatraveljoy.com” and its associated clients (including Apps, WeChat Mini Programs, or H5 pages). Applicable terminal devices for these clients include but are not limited to PC, tablet computer, mobile phone, TV, etc.

– “User” refers to any natural person who accesses or uses the products or services provided by the china travel joy Platform, including but not limited to registered users and unregistered users. Any individual who uses the products or services of the china travel joy Platform without registration shall become a “Non-Registered User” upon initial use and must comply with all provisions of this Agreement except those exclusively applicable to registered users.  

By accessing the china travel joy Platform or using Du Mei ’s products/services as a user of china travel joy or its partner companies, you are deemed to have agreed to all terms of this Agreement and other rules, statements, and operational guidelines published on the china travel joy Platform.  

2. Service instructions

The china travel joy Platform operates through its own systems to provide users with various products or services via the internet. You need to:

• Procure and configure necessary internet access devices by yourself, including but not limited to PC, mobile phone, tablet computer, etc., and bear all associated costs for internet connectivity, telecommunication charges, and other fees related to accessing these services.
• Given the importance of the products or services offered by the china travel joyPlatform, you agree to:
  • Provide authentic, complete, and accurate personal information when registering for a china travel joy Platform account. You are prohibited from using others’ email addresses, mobile phone numbers, or other forms of identity impersonation for account registration.  
  • Promptly update your information if any changes occur after registration. If the information you provide is found to be unlawful, false, inaccurate, or incomplete, you shall bear all corresponding responsibilities and consequences arising therefrom, and china travel joyPlatform reserves the right to terminate your access to any products/services under such circumstances.  

3. Amendment to the Service Agreement

In accordance with changes in the national laws and regulations of China, operational requirements, or to improve service quality, china travel joy Platform will, when necessary, make timely modifications or updates to this agreement and/or its rules. Such amendments or updates will be announced or notified in advance on the relevant pages of china travel joy Platform’s website or its mobile client. The modified/updated text will take effect on the date specified in the relevant update notice. However, china travel joy commits to announcing or notifying at least seven days prior to the effective date.

You should review promptly and learn the relevant modifications or updates. If you disagree with the proposed modifications or changes, you have the right to submit feedback to china travel joy Platform before the effective date specified in the notice. If your feedback is adopted, china travel joy may make appropriate adjustments to the changes. If you continue to object to the amendments after they take effect, you may stop using the services involved in these changes. In such cases, the modifications or changes shall not be binding on You. 4. Service Modification, Suspension, and Termination

You fully understand and agree that the services involve internet and mobile communication technologies, which may be affected by unstable factors at various stages. Therefore, china travel joy shall not be liable for any losses incurred due to service interruptions, cancellations, or terminations caused by force majeure, computer viruses, hacker attacks, system instability, user location, device shutdowns, internet connectivity, communication line failures, personal travel document issues, or other unforeseeable or uncontrollable circumstances beyond Du Mei ’s reasonable control, to the extent permitted by law.

You fully understand and agree that, except as otherwise stipulated in this Agreement, china travel joy reserves the right to modify, suspend, or terminate all or part of its services due to the particularity of online services. china travel joy shall not be liable for such modifications, suspensions, or termination of services, except in cases where you have already completed payment and received confirmation for products/services ordered or applied for through the china travel joy Platform. Nevertheless, china travel joy will endeavor to provide advance notice and allow you reasonable time to address any related rights or interests.  

5. User Conduct Guidelines

When using the products or services of the China Travel Joy Platform, you must comply with the relevant laws and regulations of the People’s Republic of China. You undertake not to engage in any illegal or improper activities through the China Travel Joy Platform’s products or services, including but not limited to the following acts:

• Uploading, displaying, posting, disseminating, or otherwise transmitting information, or accessing the China Travel JoyPlatform or using its products/services for any illegal This includes, without prior authorization, using the China Travel Joy Platform to conduct activities involving any of the following content:  
  • Opposing the fundamental principles established by the Constitution of the People’s Republic of China; endangering China’s national security, disclosing China’s state secrets, subverting state power of China, or undermining China’s national unity; damaging national honor and interests; inciting ethnic hatred, ethnic discrimination, or undermining ethnic unity;violating China’s state religious policies or promoting cults and feudal superstitions; or containing other content restricted or prohibited by Chinese laws, regulations, rules, ordinances, or any legally binding norms.
  • Spreading rumors, disturbingsocial order, undermining social stability; disseminating obscenity, pornography, gambling-related, violence, homicide, terror or abetting crime.
  • Fake, illegal, misleading, defamatory, obscene, pornographic, indecent, salacious, suggestive, harassing(or advocating harassment of others), threatening, infringing privacy or image rights, abusive, inflammatory, discriminatory, offensive, fraudulent, or otherwise objectionable content.
  • Those that may causeminors to imitate unsafe behaviors or violate social ethics, or induce minors to have bad habits, etc.
  • Any third party’s private information, including but not limited to addresses, phone numbers, email addresses, national insurance numbers, and credit card numbers. Please note that individuals’ surnames may be published on our website only with the explicit prior consent of the identified person(s).
  • Impersonating any individual or entity or otherwise distorting your relationshipwith a person or entity (including the China Travel Joy Platform).   
• Actions that disrupt the platform’s transaction order, including but not limited to:  
  • Purchasing services/products beyond reasonable personal consumption  
  • Malicious orders, malicious rights protection, fraudulent transactions, etc.

The occurrence of any such actions will be deemed as a fundamental breach of this Agreement. Under any circumstances, if China Travel Joy Platform reasonably believes that you have engaged or may engage in the above behaviors (including detection through technical rules or verification), it reserves the right to delete any information you post or disseminate without prior notice and suspend or terminate your access to China Travel Joy Platform’s products/services at any time. You shall bear legal liability for your actions while accessing or using China Travel Joy Platform’s products/services.

6. Intellectual Property

All content (including but not limited to products, web pages, text, images, audio, video, data, and information) used in or generated by the products/services provided on the china travel joy Platform is the intellectual property of china travel joy. The ownership and intellectual property rights of china travel joy shall not be transferred due to any of your usage actions. Without the prior written consent of china travel joy, you cannot use any of the above content in any form or create derivative works based on it, except in cases where:  

– You are the rights holder of the work.

– You have obtained authorization from the relevant rights holder, or

Intellectual Property and User Content Authorization

• The content is either originalor you have obtained all necessary legal authorizations for its use.
• The intellectual property rights of such content belong toyou or the relevant rights holder. 
• You aresolely responsible for all content you upload or publish.  

China travel joy reserves the right, at its sole discretion, to delete, block, or disconnect links to any content that violates laws, regulations, or third-party rights (including intellectual property rights). You shall bear full liability for any disputes arising from the infringement of others’ intellectual property rights, and if china travel joy suffers losses due to your actions, china travel joy has the right to claim compensation from you in accordance with applicable laws.  

License Grant to China Travel Joy 

By uploading, publishing, or transmitting content on the china travel joy Platform (including but not limited to products, web pages, text, images, audio, video, data, and information), you commit to grant china travel joy and its designated third parties a worldwide, royalty-free, perpetual, non-exclusive, and re-licensable license, including but not limited to the rights to:  

– Reproduce, translate, disseminate via information networks, adapt, create derivative works, perform, display, broadcast, film, and publish the content. 

– Use the content for commercial development, promotion, and marketing purposes.  

This license applies to china travel joy Platform, and any other websites, applications, products, or terminal devices designated by china travel joy.  

Enforcement Authorization

You confirm and agree that china travel joy may, in its own name or through authorized professional third parties, take legal action against any infringement of your intellectual property rights in the uploaded content. The forms of rights protection include but are not limited to:

Therefore:  

• If you are a minor under 18 years old, you must obtain your guardian’s consent to this Agreement before using china travel joyP If you fail to obtain such consent, your guardian could notify china travel joy Platform to process the relevant account. china travel joy Platform reserves the right to restrict account functions (including but not limited to browsing, posting information, and interacting with others).  
• Weattach great importance to the protection of minors’ personal information and privacy. We strongly remind you to exercise caution when sharing minors’ personal details and to obtain consent from legal guardians before posting any content involving minors (such as portraits, voices, etc.). Please make sure that we are permitted to use and process such content related to minors in accordance with this Agreement. If any content infringes upon minors’ rights, we reserve the right to handle it upon receiving notification from the rights holder or based on other considerations to safeguard minors’ legal interests.
• Wewill collaborate with guardians to protect minors’ physical and mental health. If you are a guardian, you should also fulfill your supervisory duties by:  

– Paying attention to their online safety.

– Guiding them to use the internet in a healthy and reasonable manner.  

Minors should learn to use the internet correctly under the supervision and guidance of their guardians, within reasonable limits, and develop good online habits to avoid excessive immersion in virtual cyberspace.  

• Teenagersmust comply with the National Convention on Youth Internet Civilization.
• Special Notice for Guardians:
• If you apply for a china travel joy Platform account as a guardian, we have the right toassume that minors have obtained your consent.
• As a guardian, please secure your payment devices, accounts, and passwords to prevent minors from making unauthorized purchases or using paid features through your account.  

8. China Travel JoyPlatform Account Registration and Usage

Therefore, please implement necessary security measures to protect your mobile devices and prevent order information leakage. If the leakage of order information and the occurrence of other consequences are not due to the errors of china travel joy (For instance, if your mobile phone is stolen or the necessary encryption measures are not set up on your phone, resulting in the illegal monitoring of order information on the china travel joy Platform, and others may use the relevant information to impersonate your identity to use the china travel joy Platform and customer service, etc.), even if you believe that the relevant behavior was not done by yourself, china travel joy will not be liable for any responsibility arising therefrom. You confirm and agree that China travel joy reserves the right to suspend or cancel risky transactions immediately (including but not limited to completed transactions), restrict account functions, and cease or terminate the provision of products/services on the China travel joy Platform to you if China travel joy reasonably believes that your account has security risks, including but not limited to:

• Above-mentioned security breaches.
• Account/payment card theft.
• Abnormal payment channel status (not limited to the following scope: risk control, fraud prevention, restrictions or suspension of card use and other abnormal states)
• The third-party claims that you have infringed upon their legitimate rights and interests and provides valid supporting materials.
• Other platform-determined risk scenarios.

You confirm and agree that you have the legal rights and responsibilities for all activities, actions and events conducted through your account. You are not allowed to transfer your account in any form, authorize others to use your account or trade your account with others.

10. The Particularity ofCancellations and Refunds

Unless otherwise specified, the products offered on china travel joy Platform primarily consist of time-sensitive travel services or products, which differ significantly from conventional online merchandise and therefore cannot accommodate standard return policies such as 7-day return guarantees. Please read the specific terms regarding product reservations and cancellations carefully. For users in the UK and EU, in the event we implement any service modifications that we reasonably believe will materially adversely affect your access to or use of our services, we will provide you with at least 30 days’ prior notice of such changes. Documentation Verification:

You should ensure the authenticity and validity of all provided documents and contact information. When booking international travel, you’re solely responsible for:

– Maintaining valid travel documents (including but not limited to passports and visas).

Cultural and Environmental Compliance:

During travel, you should:

– Respect local religious beliefs, ethnic customs, and cultural traditions.

– Consciously protect the natural environment.

Insurance Recommendation:

For comprehensive protection, china travel joy Platform strongly recommends obtaining appropriate travel insurance based on personal needs.

Financial Authorization:

China travel joy Platform reserves the right to:

– Collect payments for booking and purchasing travel products.

– Obtain necessary personal information strictly for product reservation and purchase services.

The china travel joy Platform will keep your personal information confidential and properly store all the certificates you submit.

Visa Requirements:

Non-Mainland Chinese passport holders or self-visa applicants must independently arrange:

13. Governing Law  

The concepts and definitions involved in this Agreement shall be interpreted in accordance with the laws of the People’s Republic of China. Any disputes arising from the booking of products or use of services through china travel joy Platform shall first be resolved through mutual consultation. If such consultation fails to resolve the dispute, either party can initiate legal proceedings at the People’s Court of Fengtai District, Beijing.  

For disputes related to the china travel joy Platform, you fully understand and agree that for civil cases meeting the criteria of small claims procedures:  

• The small claims process shall apply, with judgments being final after first instance.  
• All matters relating to such proceedings – including trial organization, time limits, procedures, and the finality of first-instance judgments – shall be governed by the Supreme People’s Court’s “Implementation Measures for the Pilot Reform of Simplifying and Differentiating Civil Litigation Procedures”.  

14. Special Notice Regarding International Use  

You understand that the internet enables cross-border access and expressly agree to:
